We inform our clients that as of 1 June 2015, the rules on deposit guarantees in bank bankruptcies have been amended. There is no longer full coverage on funds in client bank accounts, but the same coverage of the actual depositor of the funds deposited through an attorney, just as with all other deposits. This means that the client’s funds in Moalem Weitemeyer Bendtsen Advokatpartnerselskab’s client bank account will be added together with any other/private funds that the client may have in the client’s own accounts in the same bank (Nordea) when assessing coverage from Garantifonden (the Danish depositor and investor guarantee centre, previously the Danish FUTOP Clearing Centre). As of 1 June 2016, the coverage includes deposits up to an amount corresponding to EUR 100,000, i.e. approx. DKK 750,000. Provided that the client has any payable loans in the same bank (Nordea), the amount owed by the client will be deducted from the client’s deposits before coverage is provided by Garantifonden. Pension accounts have unlimited coverage. Deposits intended for social purposes under law, e.g. industrial or personal injury compensation or compensation from the Employees Guarantee Fund etc., are protected with up to EUR 150,000, i.e. approx. DKK 1m, for a maximum time of six months from the time when the funds were deposited into the account. Deposits resulting from damages caused by crime or erroneous convictions are also protected with up to EUR 150,000, i.e. approx. DKK 1m, for a maximum time of six months from the time when the funds were deposited into the account. Deposits resulting from real estate transactions that have been used primarily, or are to be used primarily, for non-commercial purposes are covered by an amount corresponding to up to EUR 10m, i.e. approx. DKK 74.5m for up to 12 months from the time when they were deposited into the account.
